Ways to offer the Maghrib Prayer late with the 'Isha Prayer - (20/11/16)

Q. If a person has not yet offered the Maghrib Prayer and entered the Masjid while the Imam was commencing the 'Isha Prayer, what should he do?  

A. He should pray behind the Imam with the intention of offering the Maghrib Prayer.
He does this by either:

- Sitting for the third Rak'ah, making the Tashhahud,  then the Tasleem. Then he gets up to pray what is left of Salaat Al-'Isha with the Imam.

- Or he can continue sitting in the Tashahhud until the Imam finishes his prayer, and then make Tasleem along with the Imam. He can then offer the 'Isha Prayer after that.

This is according to the Shafi'i Madh'hab, as well as one of the two opinions of Imam Ahmed, and a group of the followers of Ibn Taymiyah.

Shaikh Ibn Uthaymeen was asked the same question, to which he replied: The most correct point of view is that if one comes while the Imam is praying 'Isha, he should intend Maghrib (and there is no harm in the difference between the intention of the Imam and the Ma'mum because of the general statement of the Prophet ﷺ: 
"إنما الأعمال بالنيات"
"The reward of the deed depends on the intention")

- If he joins the congregation in the second Rak'ah, he makes Tasleem along with the Imam (as he would have prayed three Rak'ahs)

- If he joins the congregation in the first Rak'ah, he sits when they get up for the fourth Rak'ah, makes Tashahhud and Tasleem, and then gets up and joins the congregation once again in offering the remaining portion of the 'Isha Prayer.

There are many evidences that indicate the permissibility of making Tasleem and departing before the Imam finishes his prayer.
The Ulama said that if one had gas or needed to answer the call of nature whilst praying, he should intend to pray individually, complete his prayer alone, and leave for a need. [Liqa Al-Bab Al-Maftooh]


Ibn Baz was asked: What should you do if you entered the Masjid when the 'Isha Prayer was being offered and you remembered that you did not offer the Maghrib Prayer?
He said: Join the congregation with the intention of Maghrib. When the Imam gets up to offer the fourth Rak'ah, sit in the third, recite the Tashahud, and wait in that position until the Imam makes Tasleem. There is no harm in the difference of intention.
Or you can offer Maghrib first and then join the congregation for the 'Isha Prayer. [Majmoo' Fatawa Ibn Baz]
